Terms of Service

1. Agreement

By accessing hatujambo.com or using HatuJambo products and services (the “Services”), you agree to these Terms of Service. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree, do not use the Services.

2. Who we are

HatuJambo provides payroll, HR, accounting, inventory, tax, and related business software. Contact: accounts@hatujambo.com, +265 (886) 961-495, Lilongwe, Malawi.

3. Accounts

• You must provide accurate registration information and keep it up to date.
• You are responsible for activity under your account and for safeguarding credentials.
• Notify us promptly of any unauthorized access or security incident.
• We may suspend or terminate accounts that violate these terms or pose a security risk.

4. The Services

HatuJambo helps businesses run payroll, manage employees, track leave, generate payslips, and related operations. Features may change over time as we improve the product. Free trials or “Start Free” offers may have limits and can be changed or ended with notice where required.

5. Your responsibilities

You agree to:

• Use the Services only for lawful business purposes
• Ensure you have rights to upload and process any employee or business data
• Verify payroll calculations, tax settings, and filings before relying on them
• Not misuse the Services, attempt unauthorized access, or disrupt the platform
• Comply with applicable employment, tax, and data protection laws in Malawi and elsewhere you operate

6. Customer data

You retain ownership of data you submit to the Services. You grant us a limited license to host, process, and display that data solely to provide and improve the Services.

7. Fees and payment

Paid plans are billed according to the pricing and terms presented at purchase or in a separate agreement. Fees are non-refundable except where required by law or expressly stated. Late or failed payment may result in suspension of access.

8. Intellectual property

The Services, software, branding, and site content are owned by HatuJambo or its licensors. You may not copy, reverse engineer, or redistribute our software except as allowed by law or written permission. Feedback you provide may be used to improve the Services without obligation to you.

9. Third-party services

The Services may integrate with or link to third-party tools. We are not responsible for third-party terms, privacy practices, or availability.

10. Disclaimer

The Services are provided “as is” and “as available.” We do not warrant uninterrupted or error-free operation. Payroll, tax, and compliance outputs depend on data and settings you provide; you remain responsible for final review and statutory filings. To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the fullest extent permitted by law, HatuJambo and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or business opportunities. Our total liability arising from the Services is limited to the fees you paid us for the Services in the twelve (12) months before the claim.

12. Indemnity

You agree to indemnify and hold HatuJambo harmless from claims arising from your use of the Services, your data, or your violation of these terms or applicable law.

13. Termination

You may stop using the Services at any time. We may suspend or end access if you breach these terms, fail to pay, or if we discontinue a service. On termination, your right to use the Services ends; provisions that should survive (including ownership, liability limits, and indemnity) will continue.

14. Changes

We may update these Terms from time to time. The “Last updated” date will change when we do. Material changes may be communicated by email or a notice in the product. Continued use after changes take effect constitutes acceptance.

15. Governing law

These Terms are governed by the laws of Malawi. Disputes will be resolved in the courts of Malawi, unless a separate written agreement says otherwise.
